These Terms of Service govern your use of the Englewood Jet Ski website, booking services, rental services, guided rides, tours, equipment, and related customer communications. By using this website, making a reservation, signing a waiver, checking in, renting equipment, operating a jet ski, riding as a passenger, or participating in any Englewood Jet Ski activity, you agree to these Terms of Service.

If you do not agree with these Terms of Service, do not use this website, make a reservation, or participate in any rental, ride, tour, or activity offered by Englewood Jet Ski.

1. Services Provided

Englewood Jet Ski may offer jet ski rentals, guided jet ski rides, sightseeing tours, dolphin tours, sunset rides, shark tooth rides, sandbar rides, private tours, group packages, add-ons, and related water recreation services.

Available services, routes, prices, ride durations, equipment, operating areas, tour stops, and add-ons may change based on weather, water conditions, staffing, equipment availability, safety requirements, daylight, local regulations, business needs, and guest eligibility.

2. Website Use

You may use this website to learn about Englewood Jet Ski, review policies, view services, make inquiries, and access booking-related information.

You agree not to use this website to:

  • Submit false, misleading, or fraudulent information.
  • Attempt to interfere with website security, booking systems, forms, payment systems, or website performance.
  • Copy, scrape, republish, or misuse website content without permission.
  • Use the website for unlawful, abusive, harmful, or disruptive purposes.
  • Misrepresent your identity, age, qualifications, contact information, or booking details.

3. Reservations and Bookings

Reservations may be made online, by phone, by message, or through another booking method approved by Englewood Jet Ski. A reservation is not guaranteed until it is confirmed and any required payment, deposit, waiver, or booking information is completed.

  • Guests are responsible for reviewing all booking details before confirming a reservation.
  • Guests must provide accurate names, contact information, guest counts, ages, requested services, and arrival information.
  • Englewood Jet Ski may refuse, cancel, or modify a reservation if incorrect, incomplete, or misleading information is provided.
  • Reservations are subject to availability, weather, equipment, staff, daylight, and safety conditions.

4. Prices, Payments, and Fees

Prices may vary by service, date, time, duration, package, add-on, group size, private booking, or booking platform. The price shown at the time of booking controls unless there is an obvious error, unauthorized discount, technical issue, or manual adjustment approved by Englewood Jet Ski.

  • Payment may be required in full or in part at the time of booking.
  • Deposits, booking fees, processing fees, taxes, service charges, damage holds, or platform fees may apply.
  • Prices and availability may change without notice before a reservation is confirmed.
  • Guests are responsible for any approved add-ons, upgrades, late fees, damage charges, rescue charges, cleaning charges, missing equipment charges, or other charges allowed by the rental agreement or posted policies.

5. Cancellations, Rescheduling, and No-Shows

All reservations are subject to the Englewood Jet Ski Cancellation Policy and Weather Policy.

  • Guests must cancel or reschedule within the required cancellation window to avoid late cancellation charges.
  • Late arrivals may lose ride time and are not guaranteed an extension.
  • No-shows may be charged the full reservation amount.
  • Weather-related decisions are made by Englewood Jet Ski based on safety, local conditions, radar, marine conditions, visibility, lightning, wind, daylight, and guide judgment.
  • A forecast showing possible rain or storms does not automatically cancel a reservation.

6. Guest Eligibility

Guests must meet all age, identification, boater education, safety, physical, and participation requirements before renting, operating, or riding.

  • A person must be at least 18 years old to rent a personal watercraft in Florida.
  • A person must be at least 14 years old to operate a personal watercraft in Florida.
  • Operators born on or after January 1, 1988 must meet Florida boater safety education requirements when required by law.
  • Renters and operators must bring valid identification and required boater safety documentation.
  • Every renter, operator, and potential operator must complete the required safety briefing before departure.

Meeting the minimum legal age or document requirements does not guarantee approval to operate. Englewood Jet Ski may refuse operation, require a guided ride, or limit participation when safety, ability, behavior, weather, equipment, insurance requirements, or operational judgment requires it.

7. Assumption of Risk

Jet skiing and water recreation involve inherent risks. These risks may include, but are not limited to, falls, collisions, wakes, waves, wind, sun exposure, lightning, sudden weather changes, marine traffic, equipment malfunction, shallow water, wildlife, floating debris, operator error, passenger behavior, and the actions of other boaters.

By participating, you understand that injuries, property damage, illness, loss, or death may occur even when safety rules are followed. You voluntarily accept the risks associated with renting, operating, riding on, or participating in any Englewood Jet Ski activity.

8. Waivers and Rental Agreements

Guests may be required to sign a waiver, release of liability, rental agreement, damage agreement, safety acknowledgment, or other participation documents before riding.

  • Refusal to sign required documents may result in refusal of service.
  • No refund is owed when a guest refuses to complete required documents after booking.
  • The renter is responsible for making sure all members of the party complete required documents when applicable.
  • Parents or legal guardians may be required to complete documents for minors.

9. Safety Rules

Guests must follow the Englewood Jet Ski Safety Policy, Boater Requirements, staff instructions, guide instructions, posted waterway rules, and all applicable laws.

Guests may not:

  • Operate recklessly, aggressively, or outside the approved riding area.
  • Operate while impaired by alcohol, drugs, or impairing medication.
  • Ignore staff, guide, law enforcement, or posted waterway instructions.
  • Remove or misuse a life jacket while on the water.
  • Operate without the engine cut-off lanyard properly attached.
  • Harass wildlife, enter restricted areas, or damage natural resources.
  • Allow an unauthorized person to operate the jet ski.
  • Tamper with equipment, safety devices, GPS devices, fuel systems, warning labels, or controls.

10. Refusal of Service and Early Termination

Englewood Jet Ski may refuse service, delay departure, require a guided ride, end a ride early, or remove a guest from the water when safety, compliance, conduct, weather, equipment, eligibility, or operational concerns require it.

Reasons may include, but are not limited to:

  • Failure to meet boater requirements.
  • Failure to complete check-in, waivers, or safety briefing.
  • Unsafe, reckless, abusive, impaired, or disruptive behavior.
  • Failure to follow staff or guide instructions.
  • Unsafe weather, water, visibility, or marine traffic conditions.
  • Equipment concerns or route restrictions.
  • Any condition that creates risk to guests, staff, equipment, wildlife, property, or other waterway users.

No refund is owed when service is refused or a ride is ended because of unsafe guest behavior, rule violations, missing documents, suspected impairment, or failure to follow instructions.

11. Equipment Responsibility and Damage

Guests are responsible for using jet skis, life jackets, safety equipment, accessories, storage compartments, keys, lanyards, and any rented or provided items properly.

  • The renter may be responsible for damage caused by collision, grounding, misuse, reckless operation, negligence, rule violations, or failure to follow instructions.
  • The renter may be responsible for lost, stolen, broken, or missing equipment.
  • The renter may be responsible for cleaning fees, rescue fees, towing fees, recovery fees, late return fees, or repair costs when applicable.
  • Englewood Jet Ski may place a damage deposit, card hold, or other security requirement before departure.
  • Damage charges may be assessed after inspection, repair estimate, invoice, or operational review.

12. Late Return and Rescue Assistance

Guests must return at the scheduled time and follow all return instructions.

  • Late returns may result in additional charges.
  • Guests must notify Englewood Jet Ski immediately if they are delayed, lost, disabled, grounded, injured, or unable to return safely.
  • Guests may be responsible for rescue, towing, recovery, or staff response costs caused by guest error, rule violations, unsafe conduct, fuel misuse, grounding, or leaving the approved riding area.
  • In an emergency, guests should call 911 first, then notify Englewood Jet Ski as soon as it is safe to do so.

13. Guided Tours and Route Changes

Guided rides and tours may include planned routes, wildlife areas, sandbar stops, sunset timing, shark tooth areas, sightseeing points, or other highlights. These features are not guaranteed.

  • Routes may change because of weather, tide, wind, wildlife activity, water levels, daylight, marine traffic, safety concerns, restricted access, equipment, or guide judgment.
  • No dolphin sighting, wildlife sighting, sunset view, shark tooth find, shelling result, sandbar stop, restaurant stop, or route destination is guaranteed.
  • Route changes made for safety or operational reasons do not automatically qualify for a refund.
  • Guests must remain with the guide and follow guide instructions during guided rides and tours.

14. Wildlife and Environmental Conduct

Guests must respect local waterways, wildlife, seagrass, shoreline areas, and protected natural resources.

  • Do not chase, feed, touch, circle, harass, or intentionally approach dolphins, manatees, sea turtles, birds, or other wildlife.
  • Follow all manatee-zone, no-wake, idle-speed, and restricted-area signs.
  • Do not damage seagrass, mangroves, oyster beds, sandbars, shorelines, or protected areas.
  • Do not throw trash, food, plastic, fishing line, or personal items into the water.
  • Guests may be responsible for fines, penalties, damage, or consequences caused by unlawful or harmful conduct.

15. Personal Belongings

Guests are responsible for their personal belongings.

  • Englewood Jet Ski is not responsible for lost, stolen, wet, damaged, or misplaced personal items.
  • Phones, keys, wallets, sunglasses, hats, cameras, jewelry, and other valuables should be secured before departure.
  • Items brought on the water may get wet, damaged, or lost.
  • Guests should use waterproof protection for small valuables if they choose to bring them on the ride.

16. Photos, Videos, and Media

Englewood Jet Ski may offer photo or video add-ons and may also capture general business media for safety, training, marketing, or promotional purposes.

  • Purchased photo or video add-ons may be affected by weather, water conditions, equipment issues, lighting, visibility, guest behavior, or route changes.
  • No specific photo, angle, wildlife moment, sunset condition, or video result is guaranteed.
  • Guests may not use cameras, phones, drones, or recording devices in a way that creates a safety risk or violates privacy, wildlife, aviation, or local rules.
  • Commercial filming, drone use, influencer shoots, or professional media production must be approved by Englewood Jet Ski in advance.

17. Website Content and Accuracy

Englewood Jet Ski makes reasonable efforts to keep website content accurate and current. However, website information may contain errors, omissions, outdated details, technical issues, or changes that have not yet been updated.

  • Service descriptions, routes, prices, availability, photos, policies, and operating details may change without notice.
  • Website photos and videos are examples and may not represent the exact equipment, route, weather, wildlife, or experience on a guest’s ride.
  • Englewood Jet Ski may correct website errors, booking errors, pricing errors, or availability errors at any time.

18. Third-Party Links and Booking Platforms

This website may link to third-party websites, booking platforms, payment processors, map services, weather services, social media platforms, review platforms, or boater safety resources.

  • Englewood Jet Ski is not responsible for third-party website content, policies, errors, outages, fees, or data practices.
  • Third-party platforms may have separate terms, privacy policies, payment rules, fees, and refund processing timelines.
  • Guests should review third-party terms before using those services.

19. Text Messages, Calls, and Email Communications

By submitting your contact information or making a reservation, you authorize Englewood Jet Ski to contact you about your inquiry, reservation, safety information, schedule changes, weather updates, payment issues, lost items, follow-up questions, and customer service matters.

  • Communications may occur by phone, text message, email, booking platform message, or website form response.
  • Message and data rates may apply depending on your carrier.
  • You are responsible for providing accurate contact information and checking messages before your reservation.

20. Minors

Minors may participate only when allowed by law, safety requirements, equipment limitations, staff judgment, and parent or legal guardian approval.

  • A parent or legal guardian may be required to sign documents for a minor.
  • Minors must follow all safety rules and staff instructions.
  • Englewood Jet Ski may refuse or limit minor participation when safety, fit, size, weather, route, or supervision concerns exist.

21. Limitation of Liability

To the fullest extent allowed by law, Englewood Jet Ski is not liable for indirect, incidental, special, consequential, punitive, or economic damages arising from website use, booking issues, weather changes, route changes, service interruptions, participation in activities, personal belongings, third-party services, or inability to participate.

Nothing in these Terms of Service is intended to limit liability in a way that is not allowed by applicable law.

22. Indemnification

You agree to be responsible for claims, losses, damages, fines, penalties, costs, expenses, or attorney’s fees arising from your violation of these Terms of Service, violation of posted policies, unsafe conduct, misuse of equipment, damage to property, injury to others, environmental harm, or violation of applicable laws.

23. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute related to this website, reservation, rental, tour, service, or these Terms of Service shall be handled in the appropriate state or federal courts serving the area where Englewood Jet Ski operates, unless another dispute process is required by a signed agreement or applicable law.

24. Changes to These Terms

Englewood Jet Ski may update these Terms of Service at any time. Updates become effective when posted on this website unless a different effective date is stated.

Continued use of the website, booking services, rentals, rides, tours, or activities after changes are posted means you accept the updated Terms of Service.
